Terms of Service

These Terms of Service ("Terms") govern your use of BentoBox Notes ("BentoBox," "we," "us," or "our") at BentoBoxNotes.Rocks. By creating an account or using the service, you agree to these Terms.

1. The service

BentoBox provides a web-based clinical note generation platform with templates, macros, interactive diagrams, and rich-text export. Notes are generated in your browser and copied into your existing EHR. BentoBox is not an EHR and is not a substitute for one.

2. Eligibility and accounts

• You must be at least 18 years old and legally able to enter contracts.
• You must provide accurate registration information and keep it current.
• You are responsible for all activity under your account and for keeping your password confidential.
• You must promptly notify us of any unauthorized access.

3. Subscriptions, auto-renewal, and billing

• BentoBox is offered as a recurring weekly subscription (Starter, Practice, and — when launched — Pro).
• Each plan begins with a 7-day free trial. You may cancel during the trial at no charge.
• Auto-renewal: If you do not cancel before the trial ends, your subscription automatically converts to a paid weekly subscription at the rate shown at sign-up. After conversion, your subscription automatically renews every 7 days and your stored payment method is charged each renewal until you cancel.
• Cancellation notice: Cancellation requires at least 7 days' notice before your next renewal date. To avoid being charged for an upcoming week you must cancel before that billing period begins. Cancellation takes effect at the end of the current billing period.
• You can cancel anytime from your profile page or via the Stripe billing portal.
• Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms.
• Prices may change with 30 days' notice. Changes will not affect the current billing period.

4. Use at your own risk & HIPAA status

BentoBox is currently not HIPAA compliant. By creating an account and using the service, you acknowledge that BentoBox is provided "AS IS" and "AT YOUR OWN RISK" and that:

• You will not enter Protected Health Information (PHI), patient names, dates of birth, identifiers, or any other PHI into the service.
• BentoBox is intended for clinical-language and template generation only; the resulting note is meant to be copied into your own HIPAA-compliant EHR or paper chart.
• You accept full responsibility for the data you input and for ensuring your use of the service complies with all applicable laws and professional regulations.
• A HIPAA-compliant Pro tier (with Business Associate Agreement) is planned but not yet available. When launched, it will be a separate paid tier with explicit BAA acceptance required.

5. Acceptable use

You agree not to:

• Use BentoBox to store, transmit, or process Protected Health Information (PHI) on our servers — notes are intended to be generated locally and copied into your EHR.
• Reverse engineer, decompile, or attempt to extract source code.
• Use the service in violation of any law or professional regulation.
• Resell, sublicense, or share your account with anyone outside your practice without written permission.
• Interfere with the operation of the service, attempt to gain unauthorized access, or run automated scrapers.
• Upload malicious code or content.

6. Your content

You retain all rights to the templates, macros, presets, and configuration you create in BentoBox. You grant us a limited license to host and display your content solely to provide the service to you.

7. Professional responsibility

BentoBox is a documentation tool. You are solely responsible for the clinical accuracy, legal compliance, and appropriateness of any note generated using BentoBox. The platform does not provide medical advice. You must apply your own professional judgment to every note.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, release updates, or modify features at any time. We are not liable for downtime, data loss, or service interruptions.

9. Termination & account deletion

You may cancel your subscription at any time (subject to the 7-day notice in Section 3). You may also request full deletion of your account and associated data at any time from your Profile page → Delete Account, or by emailing privacy@bentoboxnotes.rocks. Account deletion is permanent and immediate. We may suspend or terminate accounts that violate these Terms, abuse the service, or fail to pay.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENTOBOX'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

12. Indemnification

You agree to indemnify and hold harmless BentoBox, its operators, and affiliates from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these Terms or applicable law.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which BentoBox is operated, without regard to conflict-of-law rules. Disputes shall be resolved in the courts of that jurisdiction unless otherwise required by law.
